Man arrested after trespassing, crawling into homeowners’ bed

A Texas man is facing multiple charges after being found inside a stranger’s home on June 2. The incident took place in Nacogdoches at approximately 1:45 a.m.

The Nacogdoches County Sheriff’s Department said that the defendant, age 38, entered a residence on CR 805, made his way to the master bedroom and crawled into bed with the owners of the home. The owners woke up and called the authorities. A deputy arrived at the scene and tried to coax the defendant out of the house. However, he allegedly became combative and began to struggle. At that point, he was placed under arrest.

The defendant was transported to Nacogdoches County Jail for processing. During a search, deputies allegedly discovered over 3 grams of methamphetamine and more than 2 grams of ecstasy pills in his possession. He was charged with possession of a controlled substance, criminal trespass of a habitation and resisting arrest.

In Texas, a conviction on drug charges can lead to a number of harsh consequences, including long prison terms, thousands of dollars in fines and a permanent criminal record. However, all defendants are innocent until proven guilty and entitled to a strong legal defense in court. As this case demonstrates, drug use can sometimes cause defendants to act erratically, which can lead to legal trouble. A criminal defense attorney could review the circumstances that led up to the arrest and push prosecutors to reduce the charges based on mitigating factors. For example, a defendant with a history of drug abuse may be better served by attending a rehabilitation program than by going to jail.
